Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account and make purchases. By using the Service you represent that you meet these requirements and that all information you provide is accurate. The Service is not directed to children under 13, and we do not knowingly allow them to use it.

2. The Service

Twisty provides AI-powered tools that generate images and videos from text prompts and/or images you supply, using third-party AI models. Outputs are produced automatically by machine-learning systems. We may add, change, suspend, or discontinue any feature at any time without liability.

3. Accounts & Security

You are responsible for all activity under your account and for keeping your credentials secure. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, at our sole discretion and without notice.

4. Subscriptions, Credits & Billing

Paid plans and credit packs are billed through your Apple App Store account. Subscriptions automatically renew for the same period and at the then-current price unless cancelled at least 24 hours before the end of the current period; manage or cancel renewals in your Apple ID settings.

ALL SALES ARE FINAL AND NON-REFUNDABLE except where a refund is required by applicable law or by Apple's policies. Credits and generations are a limited, revocable license to use the Service, have no cash value, are non-transferable, and may expire as described in the app. Unused credits are forfeited on cancellation, termination, or expiry. Prices, plans, and credit costs may change at any time; changes apply to future purchases and renewals.

5. Acceptable Use

You agree NOT to use the Service to create, upload, or share content that: (a) is illegal, infringing, defamatory, hateful, harassing, or obscene; (b) is sexual content involving minors, or non-consensual or intimate imagery; (c) depicts a real, identifiable person (including "deepfakes" or likeness/voice) without that person's consent; (d) impersonates others or is intended to deceive, defraud, or mislead; (e) infringes any intellectual property, privacy, or publicity right; or (f) violates any law or third-party right. You are solely responsible for your inputs and for obtaining all rights and consents needed for any image, name, or likeness you submit. We may remove content and suspend accounts at our discretion.

6. Your Content & Generated Output

"Input" means the prompts, photos, and other materials you submit; "Output" means content the Service generates for you. As between you and us, you retain ownership of your Input. To operate the Service, you grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and transmit your Input and Output to provide, secure, and improve the Service.

YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE ANY OUTPUT. We make no representation that Output is accurate, original, non-infringing, or suitable for any purpose, and we do not endorse or assume responsibility for any Output or for how you or anyone else uses it. Due to the nature of AI, Output may be inaccurate, unexpected, offensive, or similar to content generated for others. You assume all risk arising from your use of Output and you are responsible for reviewing it and ensuring your use complies with all laws and third-party rights.

7. Intellectual Property

The Service, including its software, design, branding, and content (excluding your Input and Output), is owned by us or our licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, reverse engineer, resell, or create derivative works of the Service.

8. Third-Party Services

The Service relies on third-party providers (including AI model providers, cloud hosting, and Apple for payments). Your use may be subject to their terms, and we are not responsible for third-party services, outages, or changes.

9. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Output will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Twisty, ITS OWNERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT, OR (B) USD $50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Twisty and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Copyright & Takedowns

We respect intellectual-property rights. If you believe content on the Service infringes your rights, contact us at legal@twisty.app with details sufficient to identify the work and the allegedly infringing material. We may remove content and terminate repeat infringers.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.

14. Changes to the Terms

We may update these Terms from time to time. Material changes take effect when posted in the app or otherwise communicated. Your continued use after changes means you accept the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or in connection with these Terms or the Service, except that we may seek injunctive or equitable relief in any court of competent jurisdiction. To the extent permitted by law, any dispute will be resolved on an individual basis, and you waive any right to participate in a class, collective, or representative action. Nothing in these Terms limits any rights that cannot be waived under the law that applies to you.

16. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. Apple is not a party to these Terms and is not responsible for the Service.
